1. Booking and Payment
1.1 A non-refundable deposit is required to secure your booking.
1.2 Full payment must be received by the nominated due date.
1.3 Yogaharta reserves the right to cancel your booking if full payment is not received by this date.
2. Cancellation and Refunds
2.1 All payments made are non-refundable, except as required under Australian Consumer Law.
2.2 If you are unable to attend, you may request to transfer your booking to another participant, subject to Yogaharta’s approval.
2.3 Yogaharta is not responsible for any third-party costs incurred, including but not limited to flights, accommodation outside the retreat dates, or travel arrangements.
3. Travel Requirements
3.1 Participants are solely responsible for arranging and covering the cost of:
- international and domestic flights
- travel insurance
- passport validity
- Indian visa requirements
3.2 Comprehensive travel insurance is mandatory and must include coverage for:
- medical expenses
- personal injury
- cancellation and curtailment
- loss or theft of personal belongings
3.3 Yogaharta accepts no responsibility for visa issues, travel disruptions, delays, or missed connections.
4. Health and Fitness
4.1 By participating, you warrant that you are physically and mentally fit to engage in yoga classes, activities, and associated retreat experiences.
4.2 You must disclose any relevant medical conditions, injuries, or limitations prior to the retreat.
4.3 You agree to take full responsibility for your participation and to modify or cease activities where necessary.
5. Ayurvedic Consultations and Treatments
5.1 Ayurvedic consultations and treatments are provided as complementary wellness services only.
5.2 These services are not intended to diagnose, treat, cure, or prevent any medical condition and do not replace professional medical advice.
5.3 You are responsible for disclosing any medical conditions, allergies, or sensitivities to the practitioner.
6. Code of Conduct
6.1 Participants are expected to behave respectfully toward facilitators, staff, and fellow guests.
6.2 Yogaharta reserves the right to remove any participant whose behaviour is deemed unsafe, inappropriate, or disruptive, without refund.
7. Changes to Retreat
7.1 Yogaharta reserves the right to make reasonable changes to the retreat schedule, accommodation, facilitators, or inclusions where necessary.
7.2 In the event the retreat is cancelled by Yogaharta, participants will receive a refund of payments made to Yogaharta, excluding any third-party costs.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, Yogaharta, its directors, employees, contractors, and agents exclude all liability for any loss, damage, injury, or expense suffered by you in connection with the retreat.
8.2 This includes, but is not limited to:
- personal injury or illness
- loss or damage to personal property
- travel disruptions or delays
8.3 Where liability cannot be excluded under Australian Consumer Law, it is limited to the resupply of the services or the cost of having the services supplied again.
9. Assumption of Risk
9.1 You acknowledge that participation in yoga, travel, and retreat activities involves inherent risks.
9.2 You voluntarily assume all risks associated with your participation and accept full responsibility for your health, wellbeing, and personal belongings.
10. Photography and Media
10.1 Photographs and video recordings may be taken during the retreat for promotional purposes.
10.2 By attending, you consent to the use of your image unless you notify Yogaharta in writing prior to the retreat.
11. Governing Law
11.1 These Terms and Conditions are governed by the laws of Victoria, Australia.
11.2 Any disputes arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
12. Acknowledgement
By booking and participating in this retreat, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and Liability Waiver.
