Terms and Conditions

General

  • Every possible effort will be made to deliver classes and services on time as advertised. However the schedule is subject to change or cancellation without notice. Teachers are subject to change without notice. Yogaharta is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.
  • Yogaharta is not responsible for the safekeeping of your belongings.
  • Yogaharta reserves the right to refuse entry at anytime.
  • Passes are non-refundable, non-transferable and cannot be suspended. Please consider this when purchasing passes with an expiration date.
  • Prices may increase from time to time to reflect increases in cost and benefits. Changes to pricing will take effect 14 days after written notice. Yogaharta is not liable to refund, transfer or offer compensation of any kind if you wish to cancel your contract and fail to provide 7 days notice before your next payment.
  • Student/Concession/Senior rates are available at 15% off the full price of all regular yoga class pricing options. These rates are only available for purchase in the studio and are not offered in conjunction with any other special offer. Proof of concession must be provided at time of purchase.

Introductory Offer - 14 days unlimited

  • The introductory offer is valid for 14 days from the pass activation date. The activation date is the date of the first class attended on the pass.
  • The introductory offer allows you to attended an unlimited number of scheduled classes for the period of 14 days.
  • The introductory offer is available for new members, one time only.

Direct debit - $44 per week unlimited membership

  • The weekly direct debit membership has a minimum term of four weeks. Payments will automatically continue on a weekly basis until cancellation of the contract (see details below).
  • The weekly direct debit membership allows you to attended unlimited regularly scheduled and advertised mat classes.
  • The weekly direct debit fee of $44 will be deducted from your nominated payment method (as specified at time of purchase). Payment in weekly increments by any other means is not permitted.
  • It is your responsibility to ensure there are sufficient funds available to cover the weekly direct debit. If your payment cannot be processed, (for whatever reason, eg. change of credit card/bank details or insufficient funds), you may be charged a declined processing fee.
  • The weekly direct debit membership payment continues until you contact us via email requesting cancellation. Please send cancellation email to yoga@yogaharta.com.au. Please note that cancellations MUST be provided in writing and with a minimum of 28 days notice to take effect.
  • Memberships can be suspended if you are going on holiday or suffer illness or injury that prevents you from practicing. Please provide a minimum of 7 days notice via email to yoga@yogaharta.com.au. The minimum period of suspension is 7 days to a maximum of 6 weeks. If memberships are suspended, payments will resume automatically when the suspension period ends.

Terms, Conditions and Waiver for Local and International Retreats

1. Booking and Payment

1.1 A non-refundable deposit is required to secure your booking.
1.2 Full payment must be received by the nominated due date.
1.3 Yogaharta reserves the right to cancel your booking if full payment is not received by this date.

2. Cancellation and Refunds

2.1 All payments made are non-refundable, except as required under Australian Consumer Law.
2.2 If you are unable to attend, you may request to transfer your booking to another participant, subject to Yogaharta’s approval.
2.3 Yogaharta is not responsible for any third-party costs incurred, including but not limited to flights, accommodation outside the retreat dates, or travel arrangements.

3. Travel Requirements

3.1 Participants are solely responsible for arranging and covering the cost of:

  • international and domestic flights
  • travel insurance
  • passport validity
  • Indian visa requirements

3.2 Comprehensive travel insurance is mandatory and must include coverage for:

  • medical expenses
  • personal injury
  • cancellation and curtailment
  • loss or theft of personal belongings

3.3 Yogaharta accepts no responsibility for visa issues, travel disruptions, delays, or missed connections.

4. Health and Fitness

4.1 By participating, you warrant that you are physically and mentally fit to engage in yoga classes, activities, and associated retreat experiences.
4.2 You must disclose any relevant medical conditions, injuries, or limitations prior to the retreat.
4.3 You agree to take full responsibility for your participation and to modify or cease activities where necessary.

5. Ayurvedic Consultations and Treatments

5.1 Ayurvedic consultations and treatments are provided as complementary wellness services only.
5.2 These services are not intended to diagnose, treat, cure, or prevent any medical condition and do not replace professional medical advice.
5.3 You are responsible for disclosing any medical conditions, allergies, or sensitivities to the practitioner.

6. Code of Conduct

6.1 Participants are expected to behave respectfully toward facilitators, staff, and fellow guests.
6.2 Yogaharta reserves the right to remove any participant whose behaviour is deemed unsafe, inappropriate, or disruptive, without refund.

7. Changes to Retreat

7.1 Yogaharta reserves the right to make reasonable changes to the retreat schedule, accommodation, facilitators, or inclusions where necessary.
7.2 In the event the retreat is cancelled by Yogaharta, participants will receive a refund of payments made to Yogaharta, excluding any third-party costs.

8. Limitation of Liability

8.1 To the fullest extent permitted by law, Yogaharta, its directors, employees, contractors, and agents exclude all liability for any loss, damage, injury, or expense suffered by you in connection with the retreat.
8.2 This includes, but is not limited to:

  • personal injury or illness
  • loss or damage to personal property
  • travel disruptions or delays

8.3 Where liability cannot be excluded under Australian Consumer Law, it is limited to the resupply of the services or the cost of having the services supplied again.

9. Assumption of Risk

9.1 You acknowledge that participation in yoga, travel, and retreat activities involves inherent risks.
9.2 You voluntarily assume all risks associated with your participation and accept full responsibility for your health, wellbeing, and personal belongings.

10. Photography and Media

10.1 Photographs and video recordings may be taken during the retreat for promotional purposes.
10.2 By attending, you consent to the use of your image unless you notify Yogaharta in writing prior to the retreat.

11. Governing Law

11.1 These Terms and Conditions are governed by the laws of Victoria, Australia.
11.2 Any disputes arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.

12. Acknowledgement

By booking and participating in this retreat, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and Liability Waiver.
